Welcome to WritingRiver! These Terms of Service ("Terms") govern your access to and use of the WritingRiver website, applications, and services (collectively, the "Service"), provided by [Your Company Name] ("WritingRiver," "we," "us," or "our").

Please read these Terms carefully before using the Service. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you may not access or use the Service.

The Service utilizes artificial intelligence, which is constantly evolving. Features and functionality may change over time.

2. Eligibility and User Accounts

You must be at least 13 years old (or 16 in the European Economic Area) to use the Service. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and keep your account information updated. You are responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. Subscriptions and Payment

Certain features or levels of the Service may require payment of subscription fees. By selecting a paid subscription plan, you agree to pay the applicable fees as described on our pricing page. All fees are handled by our third-party payment processor ([Insert Payment Processor Name]).

Subscriptions will automatically renew at the end of each billing cycle (e.g., monthly or yearly) unless you cancel your subscription through your account settings before the end of the current cycle. Fees are non-refundable except as required by law or as explicitly stated in a separate refund policy. We reserve the right to change subscription fees upon reasonable notice.

4. User Content

A. Your Ownership

You retain ownership of all intellectual property rights in the content you create, input, or upload to the Service, including your outlines, drafts, character descriptions, plot points, and other creative materials ("User Content"). These Terms do not grant us any ownership rights to your User Content.

B. Limited License to WritingRiver

To operate and provide the Service, you grant WritingRiver a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, process, analyze, store, transmit, and display your User Content solely for the following purposes:

  • Providing the Service features to you (e.g., generating drafts, running BERT/CLEO analysis, displaying your outlines).
  • Operating, maintaining, and improving the Service (e.g., analyzing usage patterns, troubleshooting). This does not include using your specific, identifiable User Content to train general AI models for other users without your explicit separate consent or proper anonymization/aggregation.
  • Ensuring security and compliance with these Terms and applicable law.

This license ends when you delete your User Content or your account, except to the extent necessary for us to comply with legal obligations or maintain backup archives for a limited period.

C. Responsibility for User Content

You are solely responsible for your User Content, including its legality, reliability, accuracy, and appropriateness. You represent and warrant that you own or have the necessary rights and permissions to use and submit your User Content to the Service and grant the license described above, without infringing any third-party rights.

5. Use of AI Features and Output

A. AI as a Tool

The AI features within WritingRiver are powerful tools designed to assist your creative process. However, AI-generated output (suggestions, drafts, analysis) may contain inaccuracies, errors, or reflect biases present in the training data. It is not a substitute for human creativity, judgment, critical thinking, or professional editing.

B. User Responsibility for Review

You are responsible for reviewing, evaluating, editing, and validating any output generated by the Service's AI features before relying on it or incorporating it into your final work. WritingRiver does not guarantee the accuracy, completeness, originality, or suitability of any AI-generated output for any particular purpose.

C. Originality

While features like the Chapter Builder are designed to emulate stylistic patterns without direct copying and incorporate originality checks, AI models learn from vast amounts of text. There is an inherent risk that generated output may unintentionally resemble existing works. You are responsible for ensuring the originality of your final work and conducting appropriate checks (e.g., plagiarism checks) if required.

D. No Legal or Professional Advice

The Service does not provide legal, financial, or professional advice. Any analysis (e.g., Success Score, Market Analysis) is provided for informational purposes only and should not be considered a guarantee of publication success or market performance.

6. Acceptable Use

You agree not to use the Service:

  • In any way that violates any applicable local, national, or international law or regulation.
  • To create, input, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • To infringe upon or violate the intellectual property rights or any other rights of anyone else.
  • To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.

IN NO EVENT SHALL WRITINGRIVER'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED POUNDS (£100) OR THE AMOUNTS PAID BY YOU TO WRITINGRIVER FOR THE USE OF THE SERVICE IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless WritingRiver and its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content (including AI-generated output) other than as expressly authorized in these Terms, or your use of any information obtained from the Service.

[Optional: Add specific dispute resolution clause, e.g., requiring arbitration or specifying court jurisdiction. Consult your lawyer.]

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, likely via email or a notice within the Service. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
